<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">近年来，西安法院妥善高效审理集中管辖范围外的涉自然资源、生态环境、文物保护案件共1346件，受理的案件呈现出案件数量逐年下降、案件类型多元、行政执法水平尚有提升空间等特点其中办理的“李某、何某民、张某勃等人破坏计算机信息系统案”入选联合国环境规划署网站刊登第三批中国环境资源司法典型案例，“陕西省西安市鄠邑区渭丰街道某村民委员会与冯某汉土地租赁合同纠纷案”被最高人民法院评为人民法院依法保护农用地典型案例，“某生物科技有限公司走私珍贵动物刑事附带民事公益诉讼案”被省高院、省人民检察院评为陕西省生态环境司法保护典型案例。</p>

<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">《白皮书》介绍了西安法院自然资源与生态环境保护的司法措施，打造高效机制，筑起坚实司法防线加强行政司法与行政执法联动先后与市自然资源和规划局、市秦岭保护局签署建立联动机制的协议，加强与行政机关的联动，凝聚生态环境保护合力；在鄠邑区秦岭生态环境保护总站设立“秦岭生态环境司法保护基地”，为西安法院开展相关案件审理和宣传秦岭生态保护司法工作开辟了新的阵地。</p>

<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">加强法院之间的司法协作与西铁中院签署《关于建立司法联动机制 助力秦岭北麓及渭河流域生态保护的协作框架协议》，并在沿山、沿河、文化遗址附近的8个区县人民法院的8个人民法庭揭牌设立“生态司法保护工作站”“历史遗址司法保护工作站”，促进西安法院属地管辖生态保护行政非诉执行工作、涉生态保护相关案件审判，与西铁两级法院集中管辖环境资源案件机制相衔接。</p>

<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">共同举行《渭河流域环境资源审判司法协作框架协议》暨《司法助力关中地区大气污染治理特别行动宣言》签约仪式，全面加强陕甘两省八家中级人民法院常态化司法协作，着力构建共建共治共享的生态环境司法保护新格局加强环资保护普法宣传。</p>

<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">立足实际，积极开展形式多样、群众喜闻乐见的秦岭生态环境保护宣传活动，让“绿色、低碳、环保”的理念深入人心着力打造环资纵横保护网围绕生态环境保护“六个一”工程，积极构建完善全方位、多层次、多角度的“1128”秦岭生态司法保障体系，即1个中心“秦岭生态环境司法保护协调中心”，1个基地“秦岭生态环境司法保护基地”，2个机制“司法协作机制、行政司法联动机制”，8个“生态司法保护工作站”。</p>

<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">会议发布了《西安法院生态环境司法保护典型案例》某生物科技有限公司走私珍贵动物刑事附带民事公益诉讼案，审理中延伸了公益诉讼的职能范围，实现了刑事、民事责任追究的全覆盖，以及境内外野生动物法律责任的平等适用，强化了对破坏“一带一路”共建国家珍贵野生动物资源犯罪的打击和保护力度，为司法机关参与共建绿色“一带一路”和生物的多样化保护探索了新的路径。</p>
<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">西安市鄠邑区某村村委会与冯某某土地租赁合同纠纷案，系人民法院在审判中落实农用地司法保护新理念的典型案件，“承租人管理不善致土地受损需担责”的审判结果，对贯彻落实农村土地司法保护政策，起到了一定的引领示范作用，对教育引导人民群众和基层党组织增强保护耕地工作的自觉性、积极性和主动性，筑牢农村土地保护屏障，维护粮食安全具有重要意义。</p>
<p style="font-size: 18px; line-height: 40px; text-align: left; margin-bottom: 30px;">10件生态环境司法保护典型案例涵盖了环境污染、生态破坏等各个领域，诠释了法律对环境违法行为的零容忍态度，彰显了司法保护生态环境的坚定决心与力量西安市公安局、市资源规划局、市生态环境局、市住建局、市水务局、市秦岭保护局等相关部门负责人，西安铁路运输中级法院环资庭负责人,西安中院各部门负责人、各区县人民法院主管院领导及相关庭室负责人、新闻媒体记者等50余人参加会议。</p>
